Acceptance of these terms
By accessing or using the Website, you agree to these Terms of Use, our Privacy Policy, and any additional terms presented to you in connection with a specific feature of the Website. If you do not agree, do not use the Website. If you are accessing the Website on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Order of precedence. If a separately signed agreement between you (or your organization) and Aler covers your use of the Website, that signed agreement controls in case of conflict, followed by these Terms of Use, then the Privacy Policy, then any in-page disclosures.
Definitions
- “Website”: the marketing and informational site at aler.ai and its subdomains, including blog and documentation pages, waitlist and contact forms, and any embedded widgets we host.
- “Content”: text, graphics, logos, code, images, videos, audio, and other materials that we publish on or transmit through the Website.
- “User Submissions”: information you submit through the Website (e.g., waitlist email, contact-form messages).
Eligibility
You must be at least 18 years old to use the Website. If you are between the ages of 13 and 17, you may use the Website only with the involvement and consent of a parent or guardian. The Website is not intended for children under 13, and we do not knowingly collect personal information from children under 13.
What this website is
The Website is a marketing and informational surface. It describes the Aler product, the science behind it, our security and privacy posture, and lets you join the waitlist or contact us. The Website does not provide healthcare services and does not deliver any clinical alerts, recommendations, analyses, or other AI-generated content.
The Aler product itself (the application, APIs, mobile clients, and clinical-intelligence services) is offered separately under the App Terms of Service at /legal/terms-of-service.
Not medical advice
Content on the Website is provided for general informational purposes only. It is not medical advice, diagnosis, or treatment. ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTHCARE PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. Do not disregard professional medical advice or delay seeking it because of something you read on the Website. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.
Statements about clinical outcomes, ROI, or comparative performance reflect Aler’s expectations or examples based on internal models, white papers, or pilot data. Actual results vary. Nothing on the Website should be construed as a guarantee of clinical, financial, or operational outcome.
Accounts and waitlist
Every page of this Website is public and none of it requires an account. Some areas ask you to provide information such as an email address so we can add you to the waitlist or reply to you. You agree to provide accurate information, to keep it current, and not to impersonate another person. Notify us at [email protected] if you believe someone has used your email address here without your permission. Accounts, credentials and the obligations that come with them are governed by the Terms of Service for the Aler application, not by these Website terms.
Where a form submission goes. The waitlist and contact forms on this Website are handled by Formspree, a third-party form-processing service, which receives whatever you type into the form (typically your email address and any message) along with your IP address, and relays it to us by email. Do not put health information, clinical details, or any other sensitive personal information into a Website form. Those forms are marketing intake, not a clinical channel, and they do not carry the safeguards that apply inside the Aler application. If you need to send us something sensitive, write to [email protected] and we will arrange a secure route.
The Website does not hold your health record. Creating an Aler account, connecting a data source, and everything else described in the Privacy Policy happen inside the application, not here.
Acceptable use
You agree not to:
- Use the Website for any purpose that is unlawful, fraudulent, or harmful, or that violates the rights of others.
- Submit content that is defamatory, infringing, hateful, harassing, sexually explicit, or that contains personal data of another individual without authority.
- Probe, scan, or test the vulnerability of the Website or attempt to bypass any access controls, except in accordance with our Vulnerability Disclosure Policy.
- Scrape, crawl, or harvest content from the Website using automated tools other than search-engine indexing for which we have published explicit allowances (e.g., robots.txt). Compliance with our published robots.txt and rate limits is a condition of access.
- Use the Website or its Content to train, fine-tune, evaluate, or otherwise build a machine-learning model without our express prior written permission.
- Reverse-engineer, decompile, or disassemble any part of the Website except to the extent applicable law expressly permits.

The Website, including its design, text, graphics, logos, code, and the underlying technology, is owned by Aler or its licensors and is protected by copyright, trademark, trade-secret, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view the Website for your personal, non-commercial use. All other rights are reserved.
You may share publicly available URLs of the Website on social media. You may quote brief, unmodified excerpts of the Content under fair use, with attribution to “Aler Health.” Beyond that, you must not reproduce, distribute, modify, prepare derivative works of, publicly display, or publicly perform the Content without our prior written permission.
User Submissions. By submitting User Submissions, you grant Aler a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use the User Submission to operate the Website, communicate with you, and improve our Services. You retain ownership of your User Submissions.
Trademarks
“Aler,” “Aler Health,” and the Aler logo are trademarks of Aler Health, Inc. Other names and logos appearing on the Website are the trademarks of their respective owners and are used for identification only. Use of the Aler trademarks requires prior written permission, except for nominative fair use.
Feedback
If you send us suggestions, ideas, comments, or other feedback about the Website or the Aler product, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use that feedback for any purpose, without obligation to you. You confirm you have the right to give us that license.
Third parties and what your browser loads
The Website may link to third-party websites, services, or content. We are not responsible for them, do not endorse them, and have no control over their privacy practices or terms. Your interactions with any third party are solely between you and that third party. The presence of a link is not a recommendation. Where a link is an affiliate or referral link, we label it as such on the page.
What your browser loads from third parties. Loading a page on this Website causes your browser to make requests to a small number of outside services, and each of those requests reveals your IP address and browser details to that service by the ordinary operation of the web. Those services are: a web-font content delivery network; an edge network that fronts the site and provides caching and denial-of-service protection; Google and Apple sign-in scripts on pages that offer those sign-in buttons; app-store badge icons; and the form handler described in Section 6 when you submit a form. The current list is maintained at /legal/sub-processors.
There are no analytics cookies, because there is no analytics platform. We do not run product analytics, session recording, heat-mapping, or behavioral tracking on this Website, we do not embed advertising or attribution pixels, and we do not collect advertising identifiers. We do not sell or share your browsing on this Website for cross-context behavioral advertising.

Accessibility
Aler is committed to making the Website accessible. We design against the Web Content Accessibility Guidelines (WCAG) 2.2 AA: semantic markup, keyboard operability, visible focus, text alternatives, and contrast are built in deliberately. Stated plainly, we have not completed a formal third-party accessibility audit or published a VPAT, and we do not claim conformance we have not verified. Commissioning that audit is on our pre-launch list. Export controls & sanctions
The Website and any Content available on it are subject to U.S. export-control and sanctions laws. You represent and warrant that: (a) you are not located in a country subject to a U.S. government embargo or that has been designated as a “terrorist supporting” country; (b) you are not on any U.S. government list of restricted parties (including the Specially Designated Nationals and Blocked Persons List); and (c) you will not access or use the Website in violation of U.S. or applicable foreign export-control or sanctions laws. We may suspend access at any time to comply with these laws.
Vulnerability Disclosure Policy
Aler welcomes good-faith security research. If you believe you have discovered a vulnerability in the Website or any Aler product, please report it to [email protected] along with steps to reproduce. The following constitutes authorized testing under our policy:
- You make a good-faith effort to avoid privacy violations, degradation of user experience, disruption to production systems, and destruction of data.
- You do not access more data than necessary to demonstrate the vulnerability, do not exfiltrate data, and securely delete any data inadvertently obtained.
- You do not exploit the vulnerability beyond the minimum required to demonstrate it; do not perform social engineering, physical attacks, or denial-of-service tests; and do not test against accounts other than your own (or test accounts we provide).
- You give Aler a reasonable time to remediate before any public disclosure.
Authorized testing is treated as authorized access for purposes of the Computer Fraud and Abuse Act and analogous state laws. We will not pursue legal action against researchers acting consistent with this policy. We do not currently operate a paid bug-bounty program; this is a coordinated-disclosure framework.
Disclaimers
The Website is provided “as is” and “as available.” To the fullest extent permitted by applicable law, Aler disclaims all warranties, express, implied, statutory, and otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, error-free operation, uninterrupted operation, freedom from viruses or harmful components, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses, or that any information on it is current, accurate, or complete.
Limitation of liability
To the fullest extent permitted by applicable law, in no event will Aler, its affiliates, or its officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business interruption, or other intangible losses, arising out of or in connection with your use of the Website. Aler’s aggregate liability for any claim arising out of or in connection with the Website will not exceed one hundred U.S. dollars (USD $100). The limitations in this section do not apply to liability that cannot be excluded under applicable law (including, in some jurisdictions, gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence).
Indemnification
You agree to indemnify, defend, and hold harmless Aler and its affiliates from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms of Use, your misuse of the Website, your User Submissions, or your violation of any law or third-party right.
Termination of access
We may terminate or suspend your access to the Website at any time, with or without cause and with or without notice, including for breach of these terms. Upon termination, your right to access the Website ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Arbitration, and Miscellaneous) will survive.
Governing law
These Terms of Use are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Subject to the arbitration agreement below, the state and federal courts located in Wilmington, Delaware will have exclusive jurisdiction over any dispute that is not subject to arbitration, and you and Aler consent to personal jurisdiction in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Arbitration & class-action waiver
Please read this section carefully; it affects your legal rights. Except for disputes that qualify for small-claims court and except for actions to protect intellectual-property rights, any dispute, claim, or controversy between you and Aler arising out of or relating to the Website or these Terms of Use will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Wilmington, Delaware (or by remote videoconference at the consumer’s request) and the award will be enforceable in any court of competent jurisdiction.
Class-action waiver. You and Aler agree that disputes will be brought only in an individual capacity, not as part of a class, consolidated, representative, or private-attorney-general action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] with the subject line “Arbitration Opt-Out” within thirty (30) days of first agreeing to these terms. Opting out does not affect any other part of these Terms of Use.
Pre-arbitration notice. Before filing for arbitration, you agree to send a written Notice of Dispute describing the basis of your claim and the relief sought to [email protected]. The parties will negotiate in good faith for sixty (60) days; if not resolved, either party may proceed to arbitration.
EU / UK consumer terms
If you are a consumer resident in the European Economic Area or the United Kingdom, the disclaimers, limitation-of-liability, governing-law, and arbitration provisions above apply only to the extent permitted by the mandatory consumer-protection laws of your country of residence. Nothing in these Terms of Use limits your statutory rights or restricts your ability to bring proceedings in the courts of your country of residence. The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr; we are not currently obligated to participate but may do so on a voluntary basis.
Changes to these terms
We may update these Terms of Use from time to time. The “Effective” date and version number above always reflect the current version. Material changes will be announced on the Website and, where we have your email address, by email at least thirty (30) days before they take effect, except where a faster change is required by law. Continued use of the Website after a change takes effect means you accept the updated terms.
Miscellaneous
- Entire agreement. These Terms of Use, together with the Privacy Policy and any in-page disclosures, are the entire agreement between you and Aler regarding the Website and supersede prior agreements on the same subject matter.
- Assignment. You may not assign these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, financing, reorganization, or sale of assets.
- Severability with reformation. If a provision is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be reformed to the minimum extent necessary to make it enforceable while reflecting the parties’ original intent.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
- Headings. Headings are for convenience only and do not affect interpretation.
- Independent contractors. Nothing in these terms creates a partnership, joint venture, employment, or agency relationship.
- No third-party beneficiaries, except that Aler’s affiliates and licensors are intended beneficiaries of the disclaimers, limitations of liability, and indemnification provisions.
- Construction. The word “including” means “including without limitation.”
